1. Acceptance of Terms

By downloading, installing, accessing, or using the DripCheck AI mobile application ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you are at least 13 years of age. If you are under 18, you represent that you have the permission of a parent or guardian to use the Service. You are solely responsible for ensuring that your use of the Service complies with all applicable laws.

3. User Accounts & Security

To use certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account information.

4. User Content & License

You retain ownership of any photos, text, or other content you upload to the Service ("User Content").

License Grant: By uploading User Content, you grant DripCheck AI a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, modify, adapt, publish, and display such content solely for the purpose of providing, operating, and improving the Service (e.g., generating try-on images, displaying your posts in the Style Feed).

We do NOT claim ownership of your User Content and will not sell your content to third parties.

5. AI Features & Disclaimers

The Service utilizes Artificial Intelligence (AI) to generate images and style suggestions. You acknowledge and agree that:

  • Simulations: Virtual try-on images are simulated visualizations and may not perfectly represent how a physical garment will fit, drape, or look in reality. They should be used for reference only.
  • Accuracy: AI suggestions are generated based on patterns and data and may not always be accurate, appropriate, or suitable for your specific situation.
  • "As Is": All AI-generated content is provided "AS IS" without warranties of any kind regarding accuracy, photorealism, or quality.

6. Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

  • Uploading content that is illegal, pornographic, violent, hateful, threatening, or harassing.
  • Using the Service for any illegal purpose or in violation of any local, state, national, or international law.
  • Attempting to reverse engineer, decompile, disassemble, or extract the source code of the Service.
  • Harassing, abusing, or harming other users or DripCheck AI staff.
  • Using any automated system (robots, spiders, etc.) to access the Service.

We reserve the right to suspend or terminate your account immediately if you violate these Terms.

7. Subscriptions & Payments

Certain features may require a paid subscription ("Premium").

  • Billing: Subscriptions are billed through your Apple App Store or Google Play Store account ("Store Account").
  • Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
  • Cancellation: You can manage and cancel subscriptions in your device's Store Account settings. Deleting the app does not cancel your subscription.
  • Refunds: Refund requests are handled entirely by Apple or Google in accordance with their respective refund policies. We do not issue direct refunds.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FITCHECK AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes via the Service or email. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
